I already have a Dam Safety (40A-4) permit for my dam.  What do I need to do now that it is regulated under ERP?

If you have an unexpired 40A-4 Construction permit, it is still valid and all of the authorized work can still be done without any change to the permit.  If you have a 40A-4 Operation and Maintenance permit, it will remain valid until a new permit is needed for repair work. What should I do if I need to repair my dam and I have a 40A-4 permit?

An ERP permit will be required to authorize repair to your dam.  In most cases this will result in a lower fee than for the 40A-4 permit.  Please see the ERP page and contact District Headquarters or the DeFuniak Springs service office if you have any questions.

If I sell my property, do I still have to transfer the Dam Safety permit to the new owner?

Yes.  The Dam Safety permit is still valid and must be transferred to the new owner.

How do I transfer a permit?

If you provide us with your name, the permit number, the new owner’s name, and mailing address within 30 days of the property sale, the transfer is automatic.

Is there a fee to transfer a 40A-4 permit?

No. There is no charge to transfer this permit.
